Thank you for writing me to express your views concering H.R. 2670, the National Defense Authorization Act (NDAA) for Fiscal Year 2024.  I am happy to respond.

I voted in favor of this important legislation which supports our men and women in uniform while ensuring the necessary resources are available to rebuild and maintain a prepared military force to safeguard our country.

Arizona is home to tens of thousands of service members from all branches of the armed forces and several military bases and installations.  I am particularly pleased that the NDAA included my amendment authorizing employees at the Yuma Proving Ground to use nonelectric vehicles in the performance of their duties.  The military is no place to experiment with untested technology and the combat readiness and training of soldiers and equipment is jeopardized by the compelled use of electric vehicles that tend to not work in the desert heat.

I am also pleased that the NDAA included another of my amendments requiring the Secretary of Defense to expeditiously disclose to the public all records relating to the war in Afghanistan, including Mr. Biden's tragic withdrawal of American forces.  In the disastrous troop withdrawal, our incompetent administration left over $80 billion of the best military equipment to our sworn enemies: China, the Taliban and Iran. Worse, Mr. Biden and his incompetent generals exposed our ground troops to hostile attacks, killing 13 of our finest soldiers.  It's long past time Biden answers for having no plan to safely remove American citizens before pulling our troops out from Afghanistan.
In addition to much-needed pay raises for our brave service members and their families, the NDAA prohibits the Secretary of Defense from paying for or reimbursing expenses relating to abortion services, establishes a Special Inspector General officer charged with overseeing all military and non-military U.S. assistance appropriated or made available for Ukraine, prohibits the Department of Defense from making participation in training or support for certain race-based concepts, including Critical Race Theory, a requirement for hiring, promotion, or retention of individuals and ends wokeness in the military by eliminating funding for drag shows and halting the Navy's promotion of a drag queen as a "Digital Ambassador."

The FY24 NDAA pushes back against the radical woke ideology being forced on our servicemen and women and restores the focus of our military preparedness.  For these reasons, I was proud to cast my vote in support of the NDAA.

Thank you for contacting me regarding the Bureau of Alcohol Tobacco Firearms and Explosive's (ATF) attempts to ban roughly 40 million pistols through the National Firearms Act (NFA). I appreciate your concern and welcome the opportunity to respond.

The NFA is an outdated law being weaponized against the American people. In the most recent attempt to abuse the NFA, the ATF released ATF 2021R-08 to regulate pistols and pistol braces under the NFA's as short-barreled rifles (SBRs), short-barreled shotguns (SBSs), and any other weapons (AOWs). Under this framework virtually nothing would qualify as a pistol and millions of lawful American gun owners would be instantly not compliant with the law and subject to additional taxes on their weapons.

Let me be clear, I do not support this proposed rule or the NFA. The ATF is an unconstitutional agency allowing the government to wage war on the 2nd Amendment. I have cosponsored legislation which bans the NFA from regulating certain guns and gun accessory, such as the NFA SBS Act and the Silencers Help Us Save Hearing Act. I am also currently in the process of drafting legislation which would repeal the NFA and require the ATF to destroy all records on American gun owners collected during its unconstitutional tenure.

I have always maintained that alcohol, tobacco, and firearms should be the name of a corner store in Arizona, not a government agency and I cosponsor legislation to eliminate ATF entirely. The 2nd Amendment is clear on its protection of your natural rights and the ATF's continued assault on this right is wrong. I do not support the outdated NFA, this proposed rule, or attempts by the federal government to make millions of Americans criminals overnight. I will fight this proposed rule.

Thank you for contacting me about H.R. 8460, the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) Improvement and Modernization (AIM) Act, which would allow the ATF to compile lists of law-abiding gun owners, currently illegal under federal law. I appreciate your thoughts on this issue and welcome the opportunity to respond.

I 100% oppose this bill and efforts by leftist politicians who want to house lists of those who exercise their second Amendment rights.  Their goal is to create as big a paper trail as possible against those wishing to exercise their constitutional right.  We know the ATF is already making lists of gun owners who made legal purchases, and they just announced plans to expand that list.   The more information the ATF collects, the easier it is to confiscate guns. The easier it is to blacklist. Citizens who oppose the regime have been added to secret lists in the hopes of prohibiting gun ownership. Without charges. Without a trial. And usually without notice. These ATF abuses are unconstitutional.  

And the ATF is chock-full of other ideas to limit and destroy the Second Amendment.  For example, the ATF has imposed dangerous regulations that would expand the number of firearms requiring serialization by a factor of ten. Many gun parts formerly free from the prying federal government would now be serialized. In addition, the ATF would expand their already illegal gun registry, currently at nearly one billion records, even further.

The ATF cleverly changed the definition of certain gun so that more guns would be considered illegal. ATF was caught red-handed recently compiling a registry of gun owners-an action explicitly contrary to federal law. That is in addition to this action to serialize thousands and thousands more firearms and expand the gun registry.

If Mr. Biden were serious about violent crime, he would be funding our police officers and rebuking Soros-funded district attorneys for aiding and abetting violent criminals. Over 33 percent of first-time gun buyers in 2021 were women. Guns allow women to stand up to criminals who would otherwise overpower them. The cure to rampant violent crime is simple: enforce the law and imprison violent thugs for decades. Federal laws that did this in the 1990's worked to reduce crime. The problem of violence is not a gun, a knife or a car that is to blame. It is in every instance, the operator of the gun, the knife or the car. People are responsible for their own violent actions. The millions of law-abiding gun owners shall not be punished for the transgressions of the violent minority.

I am pursuing legislation in many areas to protect our right to defend ourselves from government. I support bills that codify a federal right to self-defense, prohibit the administration from criminalizing many legal guns owned by Americans for decades through crafty and illegal regulatory maneuvers, defund federal attempts to prop up state registries of gun ownership, destroy all current ATF records of gun purchases, and nullify all ATF regulations approved by this gun-grabbing administration.

Joe Biden's radical agenda to destroy our Second Amendment is not only unconstitutional but immoral and a threat to our republic. Rest assured that I will doggedly continue to fight this administration's gross usurpation of Constitutional rights.

Thank you for contacting me about H.R. 1808, the Assault Weapons Ban of 2022, which bans semiautomatic weapons-which it defines very broadly, and H.R. 2814, the Equal Access to Justice for Victims of Gun Violence Act, which would hold gun manufacturers liable for crimes committed by those who bought their guns. I appreciate your thoughts on this issue and welcome the opportunity to respond.

Democrats recently passed legislation that furthers their assault on law abiding gun owners.  H.R. 1808, the Assault Weapons Ban of 2022, would ban AR-15s and similar semi-automatic rifles, which are among the most popular firearms being sold today, with over 24 million in circulation.

As members of Congress, the very first thing we must do before participating in Congress is to get sworn in.  We literally pledge to uphold the Constitution.  Owning a firearm is a protected civil right under the Second Amendment.  That right has been protected from Leftist attacks by our Supreme Court as recently as two months ago, where it struck down gun control laws banning handguns for self-defense.  How any member of Congress can, in good faith, vote to ban a citizen's right to self-defense is beyond me.  The Constitution is not a recommendation or guideline.  It is the premier law of the land.  That includes owning weapons for self-defense against criminals and tyrants.  

The democrat's unconstitutional gun control bill bans many common handguns, sporting rifles, and magazines. The bill would ban future civilian sales of magazines capable of holding more than 10 rounds. Did you know that over 14 million Americans purchased a firearm for the first time in 2020 and 2021? Why, because new gun owners are embracing the Second Amendment by choosing to own a firearm for lawful purposes including self-defense.  

I've repeatedly stated that you cannot fix criminal behavior by controlling law-abiding gun owners and this latest legislation will not save lives and will do absolutely nothing to stop gun violence or solve the issues largely contributing to gun violence.  

H.R. 2814 is a travesty and an abomination against our cherished Second Amendment. Americans have a right to bear arms to protect themselves from a tyrannical federal government. This legislation would ensure the end of the gun manufacturing industry, as Leftists would sue them out of existence.

I will always stand for the Second Amendment rights of all Americans and that is why I voted against H.R. 1808 and do not support H.R. 2814.

It didn't take long for Joe Biden, most democrats and some Senate Republicans to use the recent shootings in Buffalo and Texas to push for gun control measures by somehow suggesting with a straight face that if it wasn't for a gun, these murderers would be well-adjusted individuals.

We know that is simply not the case. The truth is, schools remain the most unprotected institutions in America, yet democrats hide from the fact that they pushed legislation to defund school police protection and fought to remove armed police from schools.

Congress should be focusing on school safety and mental health, not gun control.

In Washington, D.C. I work in Congress where we are surrounded by a large police force. There are guarded points of entry. Every time I travel to an airport there is the same: armed security and metal detectors. If members of Congress and every day travelers have this level of security, why can't we secure our schools with single entry points and security? Don't tell me we don't have the money. Over my strong objections, Congress just voted to send Ukraine $62 billion and we wasted trillions of dollars in Afghanistan and Iraq "building" schools and security there. It is time we help our own people for once.  

The truth is that America is approaching a tipping point where the values that led to its success are being attacked by those who want to radically change the nation, including the ruling class, woke corporations, the liberal media and school boards. Things are getting darker and darker in our country and the ruling class and their allies continue to talk in ways that are remarkably destructive, and our nation is paying a heavy price.

The leftists want your guns and to take away your right to self-defense. They use tragedies like this to push that unconstitutional notion all the while claiming it's for "the children." Like the democrat run cities, they want the people defenseless at the mercy of criminals and big government.  

Our leaders in Washington swore oaths to defend and uphold the rights enumerated in the Constitution. And the Second Amendment places clear limitations on government power to restrict lawful gun ownership.

This bill is just another attempt to strip people of their constitutional right to defend themselves, and I oppose it utterly.

Dear Mr. Lines,Thank you for contacting my office with your concern over the rulemaking authority of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). I appreciate your thoughts on this matter and welcome the opportunity to share my perspectives on this issue and action I am taking to correct this matter. The United States bureaucracy existing in the various agencies and departments which govern our country have become a source of gross government overreach, inefficient governing, and implicit with liberal bias. Under the traditional policymaking structure of the federal government, Congress passes a law and with it grants rulemaking authority to the agencies to implement provisions in the law. Such allows the agencies with personnel and expertise to take Congressional intent when writing laws to implement and enforce according to the three branch structure created by the Founding Fathers. One flaw in the modern policymaking process is something the Founders never could have envisioned: a broken government system. Today, Congress writes laws that are vague and leave much to be interpreted, and at the same time liberals in the government have allowed for the federal workforce and unions to grow at an unprecedented pace. Now, agencies such as the ATF are not only larger than we intended, but they have large authority to issue rules as they see fit because lazy or political members of Congress did not give them proper instructions. Another major issue with this bloated and liberal bureaucracy is its ability to continually force out of date laws, laws which politicized and inefficient leaders like Nancy Pelosi refuse to address. Because of these blatant errors in our policymaking process, government entities like the ATF have greatly expanded their power from rulemaking with Congressional and Presidential authority to serving a quasi-legislative role. This is harmful because it one, allows the bureaucracy to eclipse the power of the people’s Congress and create an unnecessary fourth branch of government, and two, because it allows the agencies and departments under the President’s control to act adverse to the President’s leadership if they disagree with their politics. Many of our constituents have written to me regarding the case of the ATF’s encroachment into the 2nd Amendment with its rule harming access to pistol braces. Specifically, the ATF decided to use outdated provisions of the National Firearms Act (NFA) of 1934 to reclassify Q, LLC’s Honey Badger Pistol as a Short Barreled Rifle (SBR), which would subject the pistol to the provisions of the NFA, including transfer taxes. The ATF has been unable to determine its stance for years on the difference between a pistol with a brace and a SBR, and its current backtracking to qualify this pistol brace as a SBR has made hundreds of gun owners who were previously in compliance with the law criminals and exposed to new taxes and fines for simply possessing a weapon that was previously legal. This reclassification by the ATF, which is averse to its precedent on allowing these braces to not be classified as a SBR, is simply unacceptable and harms our 2nd Amendment rights. It is an example of the issues with the current bureaucracy, one which is not just opposed to gun rights but which is using an outdated law to harm our rights. When the NFA was written, the U.S. Government was battling the mafia and the weapons which fueled its gang wars and violence. Well Al Capone and Lucky Luciano are no longer threats to America, and using this outdated law to go after current gun owners is unconstitutional. That is why in December of 2019, I joined several of my pro-gun colleagues to introduce H.R. 5289, the Home Defense and Competitive Shooting Act. Among other things, this bill removes SBRs from the definition of a firearms for the purposes of the NFA. This is a simple and easy fix to protect our rights – a pistol brace cannot be subject to taxes and fines for noncompliance when the law it supposedly violates no longer exists. Firearm owners would no longer need to determine the length of their gun barrels or determine if the weapon has a brace or butt stock. In short, what we currently define as SBRs would seize to exist and could be bought and sold just as any other rifle. Thank you again for writing me with your concern regarding the ATF’s overreaching powers which are a byproduct of the larger issues with the modern bureaucracy. In the case of the ATF, its overreach is even more dangerous as it encroaches on our Constitutional 2nd Amendment rights. Presendent Trum and fellow Arizona Senators and Representatives ,

I am writing today about an alarming action being taken by the BATF. According to the law firm of Wiley and Rein, the BATF is secretly changing firearms laws and subverting an Executive Order by the President of the United States to place lawful gun owners in grave legal jeopardy. 

The BATF are currently considering any AR15 pistol, or other firearms which are pistol versions of commonly owned and used rifles, to be illegal “any other weapons” (AOW) under the National Firearms Act. This secret move puts millions of lawful gun owners at risk of being arrested and charged with owning an illegal firearm that was legally purchased and is still being sold nationwide by gun stores. 

I ask that you read the letter from the law firm of Wiley and Rein by following the attached URL to their website. I also ask that you take immediate and swift action to stop the rogue actions of the BATF. Their unprecedented actions are placing millions of law abiding Americans in serious legal jeopardy, and they don’t even know it. 

This unbelievable action by the BATF is repugnant to the Constitution of the United States and should be of great concern by all Representatives in Congress.
